These General Terms of Use are intended to define the terms of use of the websites and applications of Procaryote such as procaryote.com (hereinafter referred to as the “General Terms of Use” or “GTU”). By accessing any of our websites or applications, you expressly and unreservedly accept these GTU and agree to comply with them.

Legal information

This website or application (hereinafter referred to as “Application”) is owned by Procaryote SRL, a private company established in Brussels, registered under number BE0834008.968, with its head office at Avenue de Vorst 78 Boulevard du Souverain, 1170 Brussels, Belgium (hereinafter referred to as “Procaryote”). The publication director of the Application is Mr. Matthieu Oliviers.

The hosting service providers for our applications and website are detailed in our standard dedicated to “Data Processors.”

Intellectual property

The application is the sole and exclusive property of Procaryote, including but not limited to the content of the Application, such as texts, logos, images, and other distinctive signs. You agree not to infringe, directly or indirectly through a third party, Procaryote’s intellectual property rights on the Application. You are prohibited from reproducing any element of the Application by any means, in any form, and on any medium, without the prior consent of Procaryote.

Personal data

In accordance with legislative provisions, the processing of personal data carried out based on information collected directly or through cookies, from users of the Application by Procaryote, is subject to a data privacy policy available on the dedicated page.

Procaryote has appointed a Data Protection Officer (DPO).

In accordance with the Data Protection Act of January 6, 1978, as amended, and the General Data Protection Regulation (GDPR), by proving your identity, you have the right to access, rectify, modify, delete, and move your data. You can also, for legitimate reasons, oppose in whole or in part the processing of data.

Procaryote provides hyperlinks to websites and other applications published and/or managed by third parties. Since no control is exercised over these external resources, you acknowledge that Procaryote declines any responsibility related to the availability of these resources and cannot be held responsible for their content.

Liability and force majeure

The Application is accessible online 24/7, except in cases of force majeure, any event beyond the control of Procaryote and/or the Site host, and any breakdown or maintenance necessary for the proper functioning of the Application. You declare that you are aware of and accept the characteristics and limits of online information transfer, as well as the costs associated with the internet connection.

Procaryote expressly reserves the right, without compensation, to modify any part of the Application at any time, as well as its presentation or support, and to interrupt the updating of the Application. Procaryote’s liability cannot be engaged for any damage whatsoever suffered by you or any third party, resulting directly or indirectly from access and use of the Application.

In any case, Procaryote’s liability, if engaged, will be limited to the direct damage suffered, excluding any indirect damage of any nature whatsoever, such as loss of data, loss of opportunities, profits, or exploitation, or any other financial loss resulting from the use or inability to use the Application.

User content

You are entirely responsible for any content you may upload, communicate, send, or make available via the Application, especially through the contact page.

Procaryote is under no obligation to retain any elements that may be transmitted via the Site and will not be required to return any elements transmitted by you. You agree to take all necessary precautions accordingly.

You hereby agree not to upload, communicate, send, or otherwise make available any content:

• that is illegal, harmful, offensive, defamatory, obscene, or otherwise punishable;

• that infringes on privacy;

• that is likely to incite violence or racial or ethnic hatred;

• that you are not legally authorized to make available (such as insider information, information belonging to another person, or confidential information);

• that infringes any intellectual property right or any other proprietary right of any other person;

• that includes any unsolicited or unauthorized advertising, promotional material, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation;

• that contains any computer virus or other computer code, file, or program designed to interrupt, damage, or limit the operation of any software, hardware, or telecommunications equipment.

By submitting content to our Application, you:

• guarantee that you have the right to do so;

• grant us, free of charge and non-exclusively, the right to modify, adapt, and use this content to process your request.

Applicable law

These GTU are governed by Belgian law.

This document is the latest version according to the version list below. We regularly review this document to ensure it is up to date and may modify it over time to reflect changes in our services and data processing activities. If we do so, we will post an update on this web page. Please check this document for any changes, as any revised version will apply upon publication by Procaryote.
